OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to struck-by hazards: (a) On March 16, 2023, at or near 58th Street NW & 102nd Avenue NW at the Lavern 42X 14BXC Well Site, near Ross, North Dakota, an employee was exposed to struck-by hazards while being hoisted by the winch line of a workover rig. Note: Among other methods, feasible and acceptable abatement methods to correct this hazard include but are not limited to: 1. Follow the American Petroleum Institute Recommended Practice 54, Occupational Safety and Health for Oil and Gas Well Drilling and Servicing Operations. Section 6.13 - Personnel Hoisting Systems. 2. Follow American Society for Mechanical Engineers B30.23 Personnel Lifting Systems - Safety Standards for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings: Section 23-0.2 3. Follow the recommendations of the manufacturer, Braden, as published in Bulletin LIT2739 (PB308).

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation, or the loss of an eye: (a) On or about March 16, 2023, at or near 58th Street NW & 102nd Avenue NW at the Lavern 42X 14BXC Well Site, near Ross, North Dakota, an employee suffered a work-related injury requiring hospitalization that was not reported to the Occupational Safety and Health Administration until 46 hours after the injury occurred.
