29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury:  (a)  On March 22, 2023, and times prior thereto, employees were exposed to caught in hazards due to not being adequately trained in the hazards associated with trenching.  (b)  On March 22, 2023, and times prior thereto, employees were exposed to struck by hazards while working near active roadways without being adequately trained in the hazards of vehicular traffic.

29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:(a)  On March 22, 2023, and times prior thereto, employees were exposed to a struck by hazard while working in a trench without a ladder or other means of egress.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).   On March 22, 2023, and times prior thereto, employees were exposed to a caught-in hazard while working in trench greater than 5 feet in depth, with no designed support system, shielding system or other protective system installed.  The American S.C. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1599481, citation number 1, item number 3 and was affirmed as a final order on October 07, 2022, with respect to a workplace located at 1567 Goliad Rd, San Antonio, TX 78233.
