29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  On or about March 23, 2023, and at times prior thereto, at the residential construction site, front elevation of a one-story home, the employer did not ensure an employee cutting bricks with a hand-held cut-off saw without the retractable lower guard wore safety glasses. Employee was potentially exposed to struck-by and flying particles hazards.

Employee was potentially exposed to respirable crystalline silica.  Pedro Rivera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1153(d)(2)(i) and 1926.1153(c)(1), which were contained in OSHA inspection number 1332364, citation number 001, item number 001, group a and b issued on July 20, 2018, and was affirmed as a final order on August 8, 2018, with respect to a workplace located at 8420 Comanche Spring Drive, Saginaw, TX 76131.
