29 CFR  1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.    a- Building Exterior: A Pettibone Power Pro All Terrain Forklift, Serial #8804 was used to raise wood members and left unattended and running with the hoisting boom fully raised as the outriggers remained unsecured above the first floor. Condition observed on or about 03/22/2023.

29 CFR 1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8m) or more above the lower levels were not protected by guardrail systems, safety net systems, or personal fall arrest systems:  a-Building #13 Drift Way Lane, Montvale NJ 07645: Employees engaged in framing activities and positioned on an unprotected framed edge were exposed to fall hazards of approximately 11ft to a concrete pad below in which a means of fall protection had not been utilized. Condition observed on or about 03/22/2023.  b-Building #13 Drift Way Lane, Montvale NJ 07645: Employees engaged in framing activities and positioned on an unprotected framed edge while removing wooden members from the forks of an Pettibone front end loader were exposed to fall hazards of approximately 11ft to a concrete pad below in which a means of fall protection had not been utilized. Condition observed on or about 03/22/2023.
