29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  On or about March 20, 2023, and at times prior thereto, each employee was not provided training to avoid unsafe conditions, such as but not limited to, the pipe plug and the hazards associated with the pipe plug and of water pressures when working within and around confined spaces.  An employee was struck-by, engulfed and trapped within a manhole and 54 inch pipe.

29 CFR  1926.1203(a):Before it began work at a worksite, the employer did not ensure that a competent person identified all confined spaces in which one or more of the employees it directed may have worked, and/or did not identify each space that was a permit space, through consideration and evaluation of the elements of that space, including testing as necessary:  On or about March 20, 2023, and at times prior thereto, employees entered confined spaces to release water pressure and sump out water without identifying or evaluating the space to determine if the space was a permit required confined spaces.  Employees were exposed to hazards such as but not limited to struck-by, engulfment and entrapment hazards.

29 CFR  1926.1203(b)(1): Where the workplace contained one or more permit spaces, the employer did not inform exposed employees by posting danger signs or by any other equally effective means of the existence and location of, and the danger posed by, each permit space.    On or about March 20, 2023, and at times prior thereto, employees who worked around or in a manhole/piping system were exposed to confined space hazards such as but not limited to engulfment, struck-by and entrapment hazards.

29 CFR  1926.1203(e)(2)(ii):When entrance covers were removed the opening was not immediately guarded by a railing, temporary cover, or other temporary barrier that would prevent an accidental fall through the opening and that would protect each employee working in the space from foreign objects entering the space.  On or about March 20, 2023, and at times prior thereto, employees worked around and next to an entrance where the cover was removed and the opening was not guarded or did not prevent an employee or objects to enter into the space exposing employees to falls, struck-by and entrapment hazards.
