29 CFR  1910.134(d)(1)(iii):The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  (a) On March 23, 2023 and at times prior thereto, the employer failed to identify and evaluate respiratory hazards in the mixing areas of the workplace, so as to determine effective means of respiratory protection for employees performing mixing operations.  The employer could not produce written evidence of an identification and evaluation of the respiratory hazards.

29 CFR  1910.134(d)(3)(iii)(B):  The employer did not ensure the air purifying respirator used for protection against gases and vapors was equipped with an end-of-service-life indicator (ESLI) certified by NIOSH for the contaminant or a change schedule developed by the employer as referenced in (d)(3)(iii)(B)(1)-(d)(3)(iii)(B)(2).   (a) On or about March 23, 2023,  and at times prior thereto, in the mixer areas, 3M half-mask dual organic vapor/P100 respirators used by employees during mixer operations for protection against unidentified organic chemicals, were not equipped with an end-of-service-life indicator (ESLI) certified by NIOSH. Alternatively, the employer did not develop a change schedule.
