29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  On or about March 24, 2023, the employer failed to implement or provide a fall protection system for each employee exposed to fall hazards 6ft or greater above a lower level. CSHO observed two individuals engaged in rough framing activities of a high pitch slope (6/12) residential roof without fall protection.

29 CFR  1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a) On or about March 24, 2023, the employer failed to ensure that the portable ladder located at the front of the building utilized to access the upper landing surface extended 3ft above the upper landing surface. The Franklin Multi-Task ladder's length did not allow for the side rails to extend 3ft and the employer failed to secure it at its top to a rigid support.

The surface that the ladder was positioned on was a gravel driveway leading to the residential home's garage. The ladder was not secured at its top nor did it extend 3ft above the upper landing surface.

CSHO observed a portable ladder in front of the home's garage which was positioned in a manner that would create or have the potential to create a serious incident.
