29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.   (a): On or about March 24, 2023, Employees working at a lower level of a scaffold were not wearing protective helmets.  Employees were exposed to struck-by hazards from falling tools, bricks and debris.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  (a): On or about March 24, 2023, The employer did not ensure that supported scaffolds had a ladder or equivalent method for employees to access the upper work platforms.  Employees climbed the side supports of the scaffold, exposing them to falls of approximately 14.6 feet to the ground below.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.   (a): On or about March 24, 2023, The employer did not ensure that supported scaffolds were free of potential fall hazards.  Employees operating at approximately 14.6 feet or more above a lower level were not protected from falling to that lower level by fall protection as established in paragraphs (g)(1)(i)-(g)(1)(vii) of this section.

29 CFR  1926.451(h)(1): In addition to wearing hardhats each employee on a scaffold shall be provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. When the falling objects are too large, heavy or massive to be contained or deflected by any of the above-listed measures, the employer shall place such potential falling objects away from the edge of the surface from which they could fall and shall secure those materials as necessary to prevent their falling.   (a): On or about March 24, 2023, The employer did not ensure that scaffolds had toeboards installed to contain or deflect tools or equipment from the upper level.  Employees operating on a lower level were exposed to struck-by hazards from falling objects.
