The lack of guards on each gaylord exposes its operators to pinch and crush points, in that employees are within arm's reach when closing or opening the gaylords while putting in or taking out molds.

29 CFR  1910.1053(h)(1): The employer shall not allow dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica unless wet sweeping, HEPA-filtered vacuuming or other methods that minimize the likelihood of exposure are not feasible.  On or about March 24, 2023 the employer allowed dry sweeping as part of cleaning operations inside of the Mill room creating an exposure to respirable crystalline silica dust to the employees inside of the Mill room. Dry sweeping operations disrupted respirable crystalline silica dust that settled on the floor and was kicked up into the air causing employees to be sweeping or nearby to be exposed to the hazard. Tasks that have dry sweeping include but are not limited to housekeeping operations such as sweeping up dust and debris using a push broom at the end of the shift.

On or about March 24, 2023 the employer failed to provide medical surveillance to employees that work inside of the Mill room who work with or in the same room as operations that expose employees to respirable crystalline silica over the Action Level. Certain tasks generated respirable silica dust at an exposure that would require employees to go under medical surveillance. These operations include but are not limited to operating powered industrial vehicles to carry sand molds to and from the departments and sweeping the sand inside of the Mill room as part of housekeeping operations.

29 CFR  1910.1053(j)(1): The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200). The employer shall ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (j)(3) of this section. The employer shall ensure that at least the following hazards are addressed: Cancer, lung effects, immune system effects, and kidney effects.  On or about March 24, 2023 the employer failed to include respirable crystalline silica as part of the employer's Hazard Communication (HAZCOM) Program. Several employees inside of the Mill room conduct tasks that create an exposure to respirable crystalline silica for all employees inside of the Mill room. Tasks include but are not limited to housekeeping operations such as sweeping up dust and debris at the end of the shift and using powered industrial vehicles to move sand to the different stations throughout the facility. Employees are exposed to levels of respirable crystalline silica dust over the Action Level which could lead to potential chronic health related illnesses to the lungs, immune system, and kidneys, including silicosis.
