29 CFR  1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment.   On or about March 17, 2023, where a hazard assessment of the work area would determine the presence of hazards, such as but not limited to overhead electrical powerlines that would necessitate the use of special protective equipment to prevent exposing employees to electric shock and electrocution hazards.  The power lines were energized at approximately 7200 volts.

29 CFR 1910.332(b)(1): Employees were not trained in and familiar with the safety-related work practices required by 1910.331 through 1910.335 that pertained to their respective job assignments:  On or about March 17,  20223, and at times prior thereto, employees assigned to power wash apartment complexes near or in the vicinity of energized overhead power lines were not trained in safety-related work practices, exposing the employees to the hazards of electric shock, severe burns and electrocution.

29 CFR 1910.333(c)(3)(i)(A): When an unqualified person is working in an elevated position near overhead lines, the location shall be such that the person and the longest conductive object he or she may contact cannot come closer to any unguarded, energized overhead line than the following distances:  (1)  For voltages to ground over 50kV - 10 feet (305 cm) plus 4 inches (10 cm) for every 10kV over 50kV.  At the jobsite, employees power washing with an aluminum ladder at a apartment complex made contact with 7,200-volt overhead powerlines. Exposing employees to electric shock, severe burns and electrocution.

[55 FR 32016, Aug. 6, 1990]   At the jobsite, employees power washing while standing on a elevated ladder near energized conductors without a trained attendant stationed near where powerlines were located exposed the employee to electrical hazards.
