29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Lot 2 Sky Way West Freeport FL. 32439:  On February 14, 2023 and prior to; the employer allowed their employees to perform roofing activities without wearing fall protection which exposed the employees to falls of 9 feet 5 inches to the ground below.  Ayala & Santamaria Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1623655, citation number 1, item number 1-a and was affirmed as a final order on October 16, 2022, with respect to a workplace located at 724 Quintana St. Lot 51 Shoal River Landing, Crestview FL 32539.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Lot 2 Sky Way West Freeport FL. 32439: On February 14, 2023 and prior to; the employer allowed employees to use an extension ladder to gain access to the roof with the rails of the ladder not extending three feet above the roof's landing that would provide safe access to the employees from a 9 foot 5 inch fall to the ground below.  Ayala & Santamaria Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1623655, citation number 1, item number 2 and was affirmed as a final order on October 16, 2022, with respect to a workplace located at 724 Quintana St. Lot 51 Shoal River Landing, Crestview FL 32539.
