29 CFR  1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1):  a) On or about February 9,2023, Fifth Third Bank failed to determine the presence, location and quantity of asbestos at 3959 N. Lincoln Avenue, Chicago IL prior to hiring ServePro for remediation work.   b) On or about March 21,2023, Fifth Third Bank failed to determine the presence, location and quantity of asbestos at 3959 N. Lincoln Avenue, Chicago IL prior to hiring American Building Resources.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

Notification either shall be in writing, or shall consist of a personal communication between the owner and the person to whom notification must be given or their authorized representatives:  a) On or about February 9, 2023, Fifth Third Bank failed to notify ServePro about the presence of asbestos in the second floor tiles at their branch located at 3959 N. Lincoln Avenue, Chicago IL.   b) On or about March 21,2023, Fifth Third Bank failed to notify American Building Resources about the presence of asbestos in the second floor tiles at their branch located at  3959 N. Lincoln Avenue, Chicago IL.
