29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Trench operation located at the corner of Lee Rd and East County Rd, Lithia Springs GA. 30122. On or about March 28, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards in that the employer failed to conduct daily inspections of the excavation prior to the beginning of the day and as needed to determine if hazards are present.

On or about March 28, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards in that the employer failed to provide adequate cave[in protection for employees working in a trench that measured 65ft long by 18ft wide by 20 - 22ft deep.

A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: (a) Trench operation located at the corner of Lee Rd and East County Rd, Lithia Springs GA. 30122. On about March 28, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards in that there was no safe means of egress located in the trench while employees worked in the trench that measured an estimated 65ft long by 18ft wide by 20 - 22ft deep.

29 CFR 1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Trench operation located at the corner of Lee Rd and East County Rd, Lithia Springs GA. 30122. On about March 28, 2023, and times prior, the employer exposed employees to cave-in/entrapment hazards in that the spoil pile and excavation equipment were not kept at least 2ft from the edge of the excavation while employees worked in the trench that measured an estimated 65ft long by 18ft wide by 20 - 22ft deep. The excavators tracks were hanging over the trench. Excavators were still in operation while employees were inside the trench and the spoil piles were placed at the edge of the trench.
