29 CFR 1926.651(i)(3): Sidewalks, pavements and appurtenant structure shall not be undermined unless a support system or another method of protection is provided to protect employees from the possible collapse of such structures: On March 29, 2023, at a worksite located at the intersection of Wisconsin Ave. and Grand Ave. in Denmark, WI; pavement immediately adjacent to an excavation was undermined and not provided with a support system. Employees accessing or walking near the excavation were not protected from falling into a potential collapse of the structure.

29 CFR 1926.652(d)(2): Manufactured materials and equipment used for protective systems shall be used and maintained in a manner that is consistent with the recommendations of the manufacturer, and in a manner that will prevent employee exposure to hazards: On March 29, 2023 at a worksite located at the intersection of Wisconsin Ave. and Grand Ave. in Denmark, WI; trench shields used for protective systems were not used in a manner that was consistent with the recommendations of the manufacturer or in a manner that would prevent employee exposure to hazards when a 6 foot by 24 foot trench shield (Model 624, S# D-125) was: a) Not stacked squarely or securely on top of an 8 foot by 20 foot trench shield (Model 820, S# D-122) exposing employees to struck-by and caught-between hazards posed by the 624 trench shield shifting or falling from the 820 trench shield. b) Placed and used in the excavation without one spreader unit (pipe) installed at the west end of the shield exposing employees to struck-by and caught-between hazards posed by the 624 trench shield shifting or falling from the 820 trench shield.
