29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  location: exterior of building on or about: 3/29/23    a)  Employees were engaged in masonry work inside a trench excavation. The spoil pile was kept directly next to the excavation.  NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.405(g)(2)(iv): Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws:  location: exterior of building on or about: 3/29/23  a) An employee was using electrical equipment, including a  Ryobi saw, while  engaged in masonry work. The extension cord was not provided with strain relief.  The Mapcrete Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.405(g)(2)(iv), which was contained in OSHA inspection number 1609981, citation number 2, item number 2 and was affirmed as a final order on 12/9/22, with respect to a workplace located at 30 W. Funston Ave., Spring Valley NY 10977.  NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1926.416(e)(1): Worn or frayed electric cords or cables were used:  location: exterior of building on or about: 3/29/23  a) Employees were using electrical equipment, including a Ryobi circular  saw, while  engaged in masonry work. An extension cord that the saw was plugged into was missing part of the insulation, exposing metal wires.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.  The Mapcrete Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.416(e)(1), which was contained in OSHA inspection number 1609981, citation number 2, item number 3 and was affirmed as a final order on 12/9/22, with respect to a workplace located at 30 W. Funston Ave., Spring Valley NY 10977.
