OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck by and/or crushing hazards from falling motor vehicles elevated on automotive lifts: On or about 2/23/23, the employer did not ensure that the employees, operating the Car-o-Liner Benchrack 5500, were protected from struck by and/or crushing hazards by falling motor vehicles from the rack at all times by conducting lift inspections, service and maintenance and operator training. As a result, a motor vehicle that was hoisted/elevated with a Car-o-Liner Benchrack 5500 was displaced and fell while an employee was performing repair and service work on it. The rack was found to have the wheel stops facing the wrong direction, and have missing bolts. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
