29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: (a) On or before March 30, 2023, the exposing employer did not ensure employees were protected from injury in that two employees performing plumbing work at the bottom of a concrete basement foundation were exposed to fall hazards while walking around the perimeter of the foundation, which was about 24 inches above ground level, as well as accessing the foundation near the front of the property. This condition exposed employees to fall hazards of approximately 10 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a) On or before March 30, 2023, the exposing employer did not ensure that each employee engaged plumbing operations at a new home build was trained to recognize the hazards of working work at the bottom of a concrete basement foundation were exposed to fall hazards while walking around the perimeter of the foundation, which was about 24 inches above ground level, as well as accessing the foundation near the front of the property. This condition exposed employees to fall hazards of approximately 10 feet.

This condition exposed employees to impalement hazards.
