A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees. a. On or about March 30, 2023, located at the worksite on the corner of 3rd Ave and Fairview Ave in Grandview Heights, Ohio, the employer did not ensure a means of egress was located in the approximately 6.2 feet deep trench while an employee was working, exposing the employee to struck-by hazards in the event of a cave in.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: a. On or about March 30, 2023, located at the worksite on the corner of 3rd Ave and Fairview Ave in Grandview Heights, Ohio, the employer did not ensure employees were protected from struck-by hazards resulting from a cave in while working in a trench that was 6.2 feet deep.
