29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports.    On or about March 30, 2023, the employer did not ensure that scaffolds were fully planked. Employees engaged in masonry installations from a metal framed scaffold were not provided with a fully planked working level, exposing employees to falls in excess of 18 feet.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces shall not be used as a means of access.  On or about March 30, 2023, Employee used the frame of the scaffold to climb down, therefore exposing employees to falls in excess of 18 feet. The employees were not provided a safe means of access to the working area of the scaffold.   Abatement certification is required o f this item in accordance with the requirements of 29 CFR 1903.19(c).

Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.   On or about March 30, 2023, Scaffolds were not erected, moved, dismantled, and/or altered under the supervision and direction of a competent person as required and/or such activities were not performed by experienced and trained employees selected for such work by the competent person. Employees were exposed to fall in excess of 18 feet due to scaffold not fully planked.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    On or about March 30, 2023, Employees performing masonry work at a residential property were exposed to fall hazards in excess of 18 feet with no proper fall protection when the employer did not ensure they were adequately trained to recognize and minimize the hazards associated with fall.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
