OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crush-by hazards when utilizing damaged steel storage racks: a) Throughout the warehouse in Rooms B, C and D: On or about March 29, 2023, the employer exposed employees to struck-by and crush-by hazards in that the ends of the storages racks 1, 7, 8, 9, 10 and 13, located near the main aisle, had bent and damaged supports, where employees worked and operated powered industrial trucks around them.
