29 CFR  1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck  a)	Gomez Roofing llc. On or about March 30, 2023 at the address of 5411 Main St, Sylvania OH 43560: The employer did not ensure an employee operating a forklift was formally trained (written) in the operation of power industrial vehicles. An evaluation of competency for the employee operating the forklift was not conducted and documented by the employer. The operating employee and others working around the forklift were potentially exposed to struck-by injuries due to operation by an unevaluated operator.

29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a)	Gomez Roofing LLC On or about March 30, 2023, at the address of 5411 Main Street, Sylvania, OH 43560. The employer did not ensure employees were protected from fall hazards while working atop a low sloped commercial structure. Employees installing insulation and single ply membrane roofing system atop the low sloped commercial roof structure (width 107 ft. x Length 170 ft.) was exposed to a fall of 25 feet to the ground below.
