29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were not standing firmly on the floor of the basket:  (a) Jobsite at N. Aurora Avenue and Route 59, Naperville, IL - On or about March 28, 2023, an employee conducting glazing operations on the platform of a Skyjack SJ66T telescopic boom lift used a guardrail as a step while at a height of around twenty-one (21) feet from the next lower level thereby exposing the employee to a fall.  Deforche Construct USA was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.453(b)(2)(iv), which was contained in OSHA inspection number 1451881, citation number 1, item number 1 and was affirmed as a final order on January 17, 2020, with respect to a workplace located at 4817 Transit Road, Depew, NY 14043.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   (a) Jobsite at N. Aurora Avenue and Route 59, Naperville, IL - On or about March 28, 2023, an employee performing glazing operations from a JLG 450AJ telescopic boom lift, around eight (8) feet above the ground, was not wearing a personal fall arrest system, thereby exposing the employee to fall hazards.  Deforche Construct USA was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.453(b)(2)(v), which was contained in OSHA inspection number 1451881, citation number 1, item number 2 and was affirmed as a final order on January 17, 2020, with respect to a workplace located at 4817 Transit Road, Depew, NY 14043.  No abatement certification or documentation is required for this item.
