29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: a) New residential construction on Lot #8, located at 78 Olive Way, Suwanee, GA 30024, Second level top plate: On or about 03/31/2023, the employer exposed employees to struck-by hazards while operating pneumatic framing nail guns, in that protective eyewear was not provided to employees engaged in framing activities operating these tools at 120 PSI.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. (a) Residential construction on Lot #8, located at 78 Olive Way, Suwanee, GA 30024, Second level top plate: On or about 03/31/2023, the employer exposed employees to fall hazards of approximately 25-feet, to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities using the top plate as a walking/working surface.
