29 CFR  1910.37(b)(4): Signs were not posted along the exit access indicating the direction of travel to the nearest exit and exit discharge when the direction of travel to the exit or exit discharge was not immediately apparent:  a) Cold Room 1; on or about February 28, 2023, and at times prior to, employees were exposed to ammonia hazards, in that the employer did not post signs along the exit routes indicating the direction of travel to the nearest exit and exit discharge to prevent delays and exposure during an emergency.

29 CFR  1910.37(b)(6):Each exit sign was not illuminated to a surface value of at least five foot-candles (54 lux) by a reliable light source and be distinctive in color:  a) Cold Room 1; on or about February 8, 2023 and at times prior to, employees were exposed to ammonia hazards, in that employer did not ensure that the EXIT sign on top of the vestibule door leading to the dock area was powered  and illuminated in order to minimize delays and prevent exposure during an emergency.

29 CFR  1910.37(b)(5): Each doorway or passage along an exit access that could be mistaken for an exit was not marked "Not an Exit" or similar designation, or be identified by a sign indicating its actual use (e.g. closet):  a) Cool Room 1; on or about February 28, 2023 and at times prior to, employees were exposed to ammonia hazards, in that employer did not ensure that  the vestibule door 3 leading to  the rail dock area and not established as an emergency exit door, was marked  with a "Not an Exit" sign or similar designation to prevent delays and exposure during an emergency.  b) Cool Room 1; on or about February 28, 2023 and at times prior to, employees were exposed to ammonia hazards, in that employer did not ensure that  the vestibule door 4 leading to  the rail dock area and not established as an emergency exit door, was marked  with a "Not an Exit" sign or similar designation to prevent exposure and delays during an emergency.

29 CFR  1910.119(n): The employer did not establish and implement an emergency action plan for the entire plant in accordance with the provisions of 29 CFR 1910.38:  a) Plant; on or about February 28, 2023 and at times prior to, employees were exposed to fire and ammonia hazards, in that the employer did not ensure that the written emergency action plan contained and described the provisions of 29 CFR 1910.38, paragraphs c and d, such as, but not limited to, procedures for emergency evacuation including type of evacuation and exit route assignments, procedures to be followed by employees who remain to operate critical plant operations before they evacuate, procedures to account for all employees after evacuation, and the function of the distinctive alarm signals.
