29 CFR 1910.1200(e)(2)(i) Multi-employer workplaces. Employers who produce, use, or store hazardous chemicals at a workplace in such a way that the employees of other employer(s) may be exposed (for example, employees of a construction contractor working on-site) shall additionally ensure that the hazard communication programs developed and implemented under this paragraph (e) include the following: The methods the employer will use to provide the other employer(s) on-site access to safety data sheets for each hazardous chemical the other employer(s)' employees may be exposed to while working. a) On or about March 23, 2023 at 100 Abbott Parkway, Tipp City, Ohio 45371, the employer did not provide Wioss East LP Sanitation Workers with on-site access to safety data sheets for chemicals such as but not limited to Clorox Regular Bleach and The Works Basic Toilet Bowl Cleaner, which had both spilled and combined to form Chlorine gas. This was most recently observed on March 30, 2023.

29 CFR 1910.1200(e)(2)(ii) Multi-employer workplaces. Employers who produce, use, or store hazardous chemicals at a workplace in such a way that the employees of other employer(s) may be exposed (for example, employees of a construction contractor working on-site) shall additionally ensure that the hazard communication programs developed and implemented under this paragraph (e) include the following: The methods the employer will use to inform the other employer(s) of any precautionary measures that need to be taken to protect employees during the workplace's normal operating conditions and in foreseeable emergencies. a) On or about March 23, 2023 at 100 Abbott Parkway, Tipp City, Ohio 45371, Meijer Distribution, Inc. did not provide any method to inform Wioss East LP employees of any of the precautionary measures that need to be taken such as personal protective equipment, spill cleanup procedures, the hazards from exposure to the chemicals, or emergency procedures to be taken when cleaning chemical spills for chemicals such as but not limited to Clorox Regular Bleach and The Works Basic Toilet Bowl Cleaner which combined during the spill and cleanup efforts to form chlorine gas. This was most recently observed on March 30, 2023.
