29 CFR  1910.178(p)(1): A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it had been restored to safe operating condition.  On or about April 3, 2023, at 701 Second Street in Monroe City, Missouri, Missouri Metalcraft did not remove the following powered industrial trucks from service when found to be in need of repair, defective, or in any way unsafe:  A) Nissan 30 Optimum, Serial CPJ01-9N2385, which had a horn that did not function and broken left and right rear lights.  B) Caterpillar 60, Model GC30, Serial 6PM01451, which did not have a rubber pedal pad on the brake pedal and did not have a front right light.  C) Toyota, Model 8FGCU25, Serial 00668, which did not have a rubber pedal pad on the brake pedal and had a broken front right light.  D) Caterpillar 55, Model G025, Serial 4EM91310, which did not have a rubber pedal pad on the brake pedal and the back-up alarm was not functioning.

Such examination were not made at least daily. Where industrial trucks were used on a round-the-clock basis, they were not examined after each shift. Defects when found were not immediately reported and corrected.  On or about April 3, 2023, at 701 Second Street in Monroe City, Missouri, Missouri Metalcraft did not adequately examine powered industrial trucks (PITs) daily and/or before being placed in service. Four PITs were in service despite examination of each PIT showing unsafe conditions such as a broken horn, a broken back-up alarm, missing and broken lights, and missing brake pedal pads.
