29 CFR 1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed: 68 Westover road, Ludlow, MA: On April 4, 2023, and at times prior, the employer had not conducted an annual or more frequent inspection of the energy control procedures including, but not limited to the Roto Die Press Brake, at least annually, to verify that each procedure was adequate and being used properly by employees: Abatement Notes: A periodic inspection shall include the following elements: - Appointment of an authorized employee to inspect each unique procedure for inaccuracies during an actual energy control task - A review by inspector with each authorized employee, of that employee's responsibilities under each energy control procedure they are authorized to use - Certification that the periodic inspections have been performed by identifying the machines or equipment on which the energy control procedures were being utilized, the dates of the inspections, the employees included in the inspections, and the persons performing the inspections *Abatement notes are intended only to provide clarity regarding existing requirements under the law or agency policies. Abatement notes do not create (or diminish) legal obligations under the Occupational Safety and Health Act

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): 68 Westover Road, Ludlow, MA: On April 4, 2023, and at times prior, employees operated a Roto Die press brake and a Pearson shear that had an incompletely guarded point of operation where metal bending and cutting operations were performed. Operator employees regularly reached within 12 inches of the press brake hazard area that had an opening greater than one quarter of an inch between the top and bottom tools. a. Roto Die press brake had an unguarded point of operation which had an opening greater than one quarter of an inch between the top and bottom tools. Additionally, the press brake had no machine guarding on the sides and back of machine which exposed non-operator employees working in the area to pinch point hazards during machine operation. b. Pearson shear had an incompletely guarded point of operation which had a two-inch opening below the guard. Additionally, the shear had no machine guarding on the sides and back of machine which exposed non-operator employees working in the area to pinch point hazards during machine operation.
