OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck by hazards: a) On or about April 4, 2023, in the truck lane of Door 38, powered industrial truck (shunt truck) operators entered Door 38, traveling through Bays 1-3 into Bay 4 where HE&M saw operators offload material from parked trailers.

29 CFR 1910.178(l)(4)(ii)(E): Refresher training was not provided to powered industrial truck operators after a condition in the workplace changed that affected safe operation of the truck: a) On or about April 4, 2023, in Bay 4 of Door 38, two trailers, twelve feet longer than the existing trailers, were utilized as part of the scrap trailer fleet. Drivers were not trained on the hazards of maneuvering longer trailers.
