29 CFR 1926.1101(k)(2)(i):Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1): (A) In the Harbor House attic, The facility owner did not determine the presence, location and quantity of asbestos containing material and or PACM prior to the upgrade and replacement of the heating ventilation and air conditioning system. On or about March 8, 2023. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
