29 CFR 1926.1101(f)(2)(i): The employer failed to ensure that the exposure assessment was conducted in time to comply with requirements which are triggered by the exposure data or the lack of a negative exposure assessment: a) 14795 Garden Road, Golden, 80401: On or about April 5, 2023, and at times prior, employees were exposed to possible asbestos during residential fire cleanup due to the employer not submitting daily personnel samples. The employer did not ensure employee exposures were below the PELs during asbestos abatement activities within containment, as required by a competent person.

29 CFR 1926.1101(f)(2)(iii):Negative Exposure Assessment: For any one specific asbestos job which will be performed by employees who have been trained in compliance with the standard, the employer did not demonstrate that employee exposures will be below the PELs by data which conform to the following criteria; a) 14795 Garden Road, Golden, 80401: On or about April 5, 2023, and at times prior, employees were exposed to possible asbestos during residential fire cleanup due to the employer not conducting a Negative Exposure Assessment. The employer did not ensure employee exposures were below the PELs during asbestos abatement activities within containment.
