29 CFR 1926.404(b)(1)(i): General. The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: location: 1st and 2nd floor on or about: 5/6/19 a) Employees were using electrical equipment, including a Makita circular saw, while engaged in carpentry trim work. The employees were not provided with GFCI protection or an assured equipment grounding conductor program. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge: location: between 1st floor and 1st floor landing on or about: 3/8/23 a) Employees used the stairs for access between the first and 2nd floor. The 6 riser stairs between the 1st floor and 1st floor landing did not have a stairrail system along one of the the open sides. NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
