29 CFR  1926.451(c)(2)(v): The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied:   a) New Hope Farm, 5937 Route 11, Homer, NY  13077, on or about 4/12/23, carpenters were working from a platform supported by a rough terrain fork truck where the platform exceeded the maximum width (relative to the fork truck) required in ASME B56.6-2002-2005.  The excessive length of the platform relative to it's support (the fork truck) applies tangential forces to the system that could cause it to fall over.  Workers were on the platform while the forklift and platform were moved.

29 CFR  1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work had the strength and structural integrity to support employees safely.  Employees were permitted to work on surfaces that did not have the requisite strength and structural integrity:    a) New Hope Farm, 5937 Route 11, Homer, NY  13077, on or about 4/6/23: A carpenter was crawling across a 2x4. laid flat across a 4 foot span between trusses (bracing), that 2x4 failed causing the worker to fall 33 feet to ground.  Abatement documentation must be submitted for this item.

Cedar Lane Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1518928, citation number 1, item number 1(a) and was affirmed as a final order on 8/3/21, with respect to a workplace located at 1024 Caldwell Hill Road, Lisle, NY  13797.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a) New Hope Farm, 5937 Route 11, Homer, NY  13077, on or about 4/6/23, carpenters were setting trusses, on the center to north side of the structure working between  21 and 33 feet from ground without fall protection.  Eight carpenters were nailing truss sections onto the beam and nailing bracing across the top of the trusses.  b) New Hope Farm, 5937 Route 11, Homer, NY  13077, on or about 4/11/23, carpenters were setting trusses, on the south side of the structure when observed working at 21 feet from ground without fall protection.  Two carpenters were nailing truss sections onto the beam and nailing bracing across the top of the trusses.          Cedar Lane Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1518928, citation number 1, item number 1(a) and was affirmed as a final order on 8/3/21, with respect to a workplace located at 1024 Caldwell Hill Road, Lisle, NY  13797.
