29 CFR  1926.102(a)(1):  The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  At this jobsite, employees were exposed to struck-by hazards while operating nail guns without wearing eye protection.   Elias Aguilar was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1512984, citation number 2, item number 1,  and was affirmed as a final order on April 5, 2021, with respect to a workplace located at 21219 Grey Bloom Ave., Tomball, Texas, 77377.

29 CFR  1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  a)  At this jobsite, employees were exposed to fall hazards of approximately 9-feet 11-inches and greater while working on a roof without tying off.   Elias Aguilar was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1495493, citation number 1, item number 2, and was affirmed as a final order on November 3, 2020, with respect to a workplace located at 6313 Superior, League City, Texas.  Elias Aguilar was previously cited Repeat for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1512984, citation number 1, item number 1, and was affirmed as a final order on April 5, 2021, with respect to a workplace located at 21219 Grey Bloom Avenue, Tomball, Texas 77377.  Elias Aguilar was previously cited Repeat for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1535469, citation number 1, item number 1, and was affirmed as a final order on September 14, 2021, with respect to a workplace located at 12914 Ocean Breeze Lane, La Marque, Texas, 77568.
