29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about April 6, 2023, employees removing existing roof shingles from a residential home, used an extension ladder to access the roof that was not erected three (3) feet above the upper landing. This exposed employees to a fall hazard of approximately 9 feet to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about April 6, 2023, employees conducting roofing work on an existing roof with a 4:12 pitch, were not wearing fall protection. This exposed employees to a fall hazard of approximately 9 feet from the roof to the ground below. Urvinas Roofing DBA Benito Roofing (Benito Hernandez) - Mario Baeza was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13) , which was contained in OSHA inspection number 1427948, citation number 1, item number 1, group c and was affirmed as a final order on November 11, 2019, with respect to a workplace located at N2240 Holy Hill Road, Greenville, WI 54942.
