29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  a) Gulf ridge drive, Lot 5: On April 6, 2023 and times prior thereto the employer exposed employees to struck-by hazards from pneumatic nail guns they were using to install shingles on a roof of new residential construction in that the employer did not require employees to wear safety glasses or face shields.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) Gulf ridge drive, Lot #5: On April 6, 2023 and times prior thereto the employer exposed employees to fall hazards by allowing employees to install roof tiles on the roof of  a new residential building under construction without fall protection exposing employees to fall hazards of 13.2 feet to the ground below.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) Gulf ridge drive, Lot #5: On or about April 6, 2023, and times prior thereto the employer exposed employees to fall hazards by allowing employees to install roof tiles on the roof of a new residential building under construction without fall protection exposing employees to fall hazards of 13.2 feet to the ground below. The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed to minimize these hazards.
