29 CFR  1926.416(a)(1): The employer permitted employees to work in close proximity to energized, unguarded, and ungrounded electric power circuits that the employee could contact in the course of their work:     a.) Ice Construction, DBA Castello Brothers Construction CBC, Blessed Sacrament Church building, 2420 Greengarden Blvd, ERIE, PA 16508 , on or about 4/7/23 and times prior thereto:  Employees were involved in roofing activities on a flat roof .  While on the roof employees were in proximity to energized electrical drop service to the building.  Roofing activities include but were not limited to: putting a new membrane on the roof.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  a.) Ice Construction, DBA Castello Brothers Construction CBC, Blessed Sacrament Church building, 2420 Greengarden Blvd, ERIE, PA 16508 , on or about 4/7/23 and times prior thereto: Employees were working on a low slope roof outside of a warning line with no additional fall protection. Employees were exposed to falls of at least 10 feet while performing work including but not limited to putting a new membrane on the roof.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1926.502(f)(1): Warning lines were not erected around all sides of the roof work area:   a.) Ice Construction, DBA Castello Brothers Construction CBC, Blessed Sacrament Church building, 2420 Greengarden Blvd, ERIE, PA 16508 , on or about 4/7/23 and times prior thereto: Employees were working on a flat roof. Employees were utilizing a warning line system that did not encompass the entire perimeter of the roof. The warning system was not present on the north and northeast corner of the structure while work was taking place.  NO ABATEMENT CERTIFICATION OR DOCUMENATION REQUIRED

29 CFR  1926.502(f)(1)(iii):Points of access, material handling areas, storage areas, and/or hoisting areas were not connected to the work area by an access path formed by two warning lines:  a.) Ice Construction, DBA Castello Brothers Construction CBC., Blessed Sacrament Church building, 2420 Greengarden Blvd, ERIE, PA 16508 , on or about 4/7/23 and times prior thereto: Employees were engaged in roofing activities on a flat roof approximately 10 feet high.  There was not an access path created by a warning line or other substantial materials to transition personnel between the ladder to the warning line system.  Roofing activities include but are not limited to attaching a new membrane to the roof.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)  a.) Ice Construction, DBA Castello Brothers Construction CBC, Blessed Sacrament Church building, 2420 Greengarden Blvd, ERIE, PA 16508 , on or about 4/7/23 and times prior thereto: Employees involved in roofing work exposed to fall hazards of 10 feet.  There was not a competent person onsite to correct to identify and correct hazards at the jobsite.  Roofing work includes but is not limited to putting a new membrane on the roof.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
