1926.1060(a)(1) The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable: (a) On or about April 10, 2023, employees were working in an excavation measuring from four (4) feet, six (6) inches to six (6) feet, eight (8) inches deep without a ladder or other acceptable means of safe egress. This exposed employees to cave-in, crushing, and engulfment hazard in an emergency. In the alternative: 29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided: a) On or about April 10, 2023, employees working in an excavation were not provided a ladder for egress when there was a minimum break in elevation in excess of twenty-four (24) inches, and required employees to step/climb onto benched area of class "C" soil mixed with other loose and fissured substrate soil materials to enter and egress the excavation.

1926.21(b)(2) The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. (a) On or about April 10, 2023, employees were working in an un-shored excavation that ranged from four (4) feet, six (6) inches deep, to six (6) feet, eight (8) inches deep, exposing employees to a cave-in hazard. The type "C" classified soil of the excavation exhibited observable fissures along the sides of the excavation, and the competent person on site did not remove employees from the excavation and install protective shoring.

Designs of support systems, shield systems, and other protective systems shall be selected and constructed by the employer or his designee and shall be in accordance with the requirements of paragraph (c)(1); or, in the alternative, paragraph (c)(2); or, in the alternative, paragraph (c)(3); or, i the alternative, paragraph (c)(4) as follows: (a) On or about April 10, 2023, employee(s) engaged in activities that included work on a water main, were not protected from cave-in by a protective system while working in a trench ranging from 6 feet deep to (6) feet, eight (8) inches deep in class "C" soil. This exposed employees to a a cave-in and engulfment hazard.
