29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. a) Worksite, Roof - On or about April 10, 2023, Refrigeration Service Company assigned employees duties and did not ensure they were provided the equipment to accomplish their assigned tasks. Employees were working on top of an exterior refrigeration unit at a height of approximately 9.3 foot without fall protection. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed: a) Worksite, Roof - On or about April 10, 2023, Refrigeration Service Company did not ensure that employees utilized an A Frame ladder in a manner for which it was intended. The ladder was propped against the refrigerator wall and used as an independent ladder to gain access to and egress from the approximately 9-foot roof of the refrigeration unit. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
