29 CFR 1926.451(g)(1)(vii):Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about March 31. 2023 and April 3, 2023 at the 216 Babbs Road Construction Project, two employees were working from a mobile scaffolding system removing the old siding boards from the tobacco barns and no fall protection system was in use.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. On or about March 31. 2023 and April 3, 2023 at the 216 Babbs Road Construction Project, two employees were working from a mobile scaffolding system and were using a ladder to access the platform and the ladder did not extend 3 feet past the platform.
