OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to stuck by and crushing hazards related to handling stone slabs:   a) In the Storage Area at 3891 Radford Road Bartow, Florida: On or about April 11, 2023, employees were exposed to the hazard of being struck-by falling quartz slab. In that, the employer did not enforce employees to stay out of the fall shadow when lifting and moving a quartz slab.

29 CFR  1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered:  a) In the Storage Area at 3891 Radford Road Bartow, Florida: On or about April 11, 2023, the employer exposed employees to crush-by and struck-by hazards when a boom attachment with a stone slab lifting clamp was used on Toyota Model 42-6FGCU25, S/N 74801 (LP) and the forklift was not marked to identify the attachment and show the weight of the truck and attachment combination.
