29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a) On April 12, 2023, EMF Finishing, Inc. did not ensure that each powered industrial truck operator was competent to operate a sitdown forklift safely as demonstrated by the completion of operator training and evaluation. Employees operated a Yale Serial No. N593151 forklift daily to move pallets and products throughout the warehouse/storage floor.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which described how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a) On April 12, 2023, EMF Finishing, Inc. did not develop a written hazard communication program that addressed all elements including labeling and other forms of warning. Employees were exposed to chemicals including, but not limited to hydrochloric acid, ammonium chloride, zinc chloride, caustic soda and chromium trioxide working along the Plating Line.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR  1910.1200(f)(6)(i):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):  a) On April 12, 2023, EMF Finishing, Inc. did not ensure that the tank of yellow chromate solution located at the end of the Plating Line was labeled, tagged or marked with the required information.   b) On June 13, 2023, EMF Finishing, Inc. did not ensure that a 55-gallon container of 902 Whitener, two 5-gallon containers of 902 Brightener, one 5-gallon container of 902 Whitener and one 5-gallon container of hydrochloric acid located in the middle of the Plating Line were labeled, tagged or marked with the required information.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   a) On April 12, 2023, EMF Finishing, Inc. did not provide employees, working on the Plating Line, with training regarding the health hazards associated with hazardous chemicals in their work area.  Employees were exposed to chemicals including, but not limited to hydrochloric acid, ammonium chloride, zinc chloride, caustic soda and chromium trioxide when working along the Plating Line.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
