29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  On or about April 12, 2023, Felipe Colon did not protect an employee from falling objects while they worked below masonry activities that were taking place from a supported frame scaffold and the roof at a worksite located at 2305 South 11th Street in St. Louis, Missouri.

29 CFR  1926.451(b)(10): Scaffold components manufactured by different manufacturers shall not be intermixed unless the components fit together without force and the scaffold's structural integrity is maintained by the user. Scaffold components manufactured by different manufacturers shall not be modified in order to intermix them unless a competent person determines the resulting scaffold is structurally sound.  On or about April 12, 2023, Felipe Colon intermixed scaffold frames from at least two different manufacturers on a frame scaffold at a worksite located at 2305 South 11th Street in St. Louis, Missouri.

29 CFR  1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) were not restrained from tipping by guying, tying, bracing, or equivalent means.  On or about April 12, 2023, Felipe Colon did not install restraints (guys, ties, bracing, or equivalent means) upon a supported frame scaffold. The least base dimension of the scaffold was 7 feet, and the total height was approximately 32 feet.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used.  On or about April 12, 2023, Felipe Colon did not provide adequate means of access to a supported frame scaffold at a worksite located at 2305 South 11th Street in St. Louis, Missouri. Employees were exposed to fall hazards from directly climbing the scaffold frames which do not have rails on both sides between frames, and the spacing between rungs was not uniform due to having intermixed parts.

On or about April 12, 2023, Felipe Colon did not ensure that each employee doing masonry activities from a frame scaffold at approximately 27 feet and 7 inches in height was protected from falls by using fall protection, such as guardrails or a personal fall arrest system, in a worksite located at 2305 South 11th Street in St. Louis, Missouri.

29 CFR  1926.451(g)(4)(xv): Crossbracing is acceptable in place of a midrail when the crossing point of two braces is between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The end points at each upright shall be no more than 48 inches (1.3 m) apart.  On or about April 12, 2023, Felipe Colon did not ensure that employees were protected from falls by having a midrail and toprail. Crossbracing served as a top rail at a worksite located at 2305 South 11th Street in St. Louis, Missouri. There was no midrail installed where employees were working upon a frame scaffold.

29 CFR  1926.451(h)(1): In addition to wearing hardhats each employee on a scaffold was not provided with additional protection from falling hand tools, debris, and other small objects through the installation of toeboards, screens, or guardrail systems, or through the erection of debris nets, catch platforms, or canopy structures that contain or deflect the falling objects. When the falling objects are too large, heavy or massive to be contained or deflected by any of the above-listed measures, the employer did not place such potential falling objects away from the edge of the surface from which they could fall and did not secure those materials as necessary to prevent their falling.  On or about April 12, 2023, Felipe Colon did not protect an employee from falling objects in addition to hardhats while working below masonry activities, that were taking place from a supported frame scaffold and the roof, at a worksite located at 2305 South 11th Street in St. Louis, Missouri. Additional falling object protection such as toeboards, screens, guardrail systems, debris nets, catch platforms, or canopy structures should have been utilized.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system.  On or about April 12, 2023, Felipe Colon did not ensure that each employee engaged in work upon the roof of a residential building was protected from falls by using fall protection. Employees worked upon a steep roof of a residential building that was over 27 feet tall in a worksite located at 2305 South 11th Street in St. Louis, Missouri.
