29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)J. Ace Construction, LLC at 7621 East 10th Street, Sioux Falls, SD 57110: On or about and at times prior to April 12, 2023, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the jobsite, materials, and equipment; conducted by a competent person. Employees were conducting framing operations on a multi-family residential property without the use of a fall protection system and were operating nail guns with a lack of Personal Protective Equipment (PPE).  This condition exposed employees to fall, body impalement, and struck-by hazards.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a)J. Ace Construction, LLC at 7621 East 10th Street, Sioux Falls, SD 57110: On or about and at times prior to April 12, 2023, the employer did not ensure that each employee that framing on a multi-family residential property with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection.  This condition exposed employees to struck-by hazards.

Ace Construction, LLC at 7621 East 10th Street, Sioux Falls, SD 57110: On or about and at times prior to April 12, 2023,  the exposing employer did not ensure that employees were protected from falls while conducting framing operations on a multi-family residential property. This condition exposed the employees to fall hazards greater than six feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladders side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)J. Ace Construction, LLC at 7621 East 10th Street, Sioux Falls, SD 57110: On or about and at times prior to April 12, 2023, the exposing employer did not ensure that the 300-pound Werner Fiberglass 8-foot A-frame ladder that the employees were using was extended at least three feet above the upper landing surface of the framed wall top plates of a multi-family residential building.  This condition exposed employees to fall hazards greater than six feet.
