29 CFR 1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows: 29 CFR 1926.502(d)(15)(i):as part of a complete personal fall arrest system which maintains a safety factor of at least two; and a. Located at 11544 Glencrest Dr. NW, Pickerington OH 43147: On or about April 12, 2023, the employer did not ensure that an employee was protected from fall hazards of approximately 12.9 feet while working from the top plate and bottom web of the roof trusses to install sheathing to the trusses of an under-construction residential home.

29 CFR 1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. a. Located at 11544 Glencrest Dr. NW, Pickerington OH 43147: On or about April 12, 2023, the employer did not provide an effective fall protection training program to ensure that employees engaged in framing activities on a residential construction home, working at heights of approximately 12.9 feet, were protected from fall hazards. Employees were using fall protection harnesses but they were not tied-off to fall protection anchors.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a. Located at 11544 Glencrest Dr. NW, Pickerington OH 43147: On or about April 12, 2023, the employer did not ensure that an employee was protected from fall hazards of approximately 14 feet through an unguarded window opening while holding onto a crane tagline to help unload sheathing to the unfinished second story of an under-construction residential home. Manuel Ulloa was previously cited under the name Ulloa Construction LLC for a violation of this Occupational Safety and Health standard 29 CFR 1926.501 (b)(13), which was contained in OSHA inspection number 1609686, citation number 1, item number 2 and was affirmed as a final order on September 13, 2022, with respect to a workplace located at 11681 Begonia Dr, PLAIN CITY, OH 43064.
