29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Scott Gibson Construction, LLC at 203 9th Avenue South, Faulkton, SD 57438: On or about and at times prior to April 11, 2023, the controlling employer did not ensure frequent and regular inspections were conducted at the jobsite. Employees and subcontracted employees were conducting framing operations on a commercial property without the use of fall protection, working from an aerial lift with no fall protection, and not using personal protective equipment (PPE) to include hard hats. This condition exposed employees to various hazards while working on the site.
