29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them:  (a)Scott Gibson Construction, LLC at 203 9th Avenue South, Faulkton, SD 57438: On or about and at times prior to April 11, 2023, the controlling employer did not ensure frequent and regular inspections were conducted at the jobsite. Employees and subcontracted employees were conducting framing operations on a commercial property without the use of fall protection, working from an aerial lift with no fall protection, and not using personal protective equipment (PPE) to include hard hats. This condition exposed employees to various hazards while working on the site.

This condition exposed employees and subcontracted employees to struck-by hazards associated with framing operations.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   (a)Scott Gibson Construction, LLC at 203 9th Avenue South, Faulkton, SD 57438: On or about and at times prior to April 11, 2023, the controlling employer did not ensure employees and  subcontracted employees were protected from falls while working from the Genie S-40 aerial lift. The training shall include the following areas, as applicable:   (a)Scott Gibson Construction, LLC at 203 9th Avenue South, Faulkton, SD 57438: On or about and at times prior to April 11, 2023, the controlling employer did not ensure that fall protection training was provided to employees prior to using the Genie S-40 aerial lift.  This condition exposed employees to fall hazards greater than six feet.
