29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: On April 12, 2023, employees of Maya Construction, LLC were installing shingles on a residential building located at 348 Mitulski Drive, Wentzville, Missouri. The employer did not ensure that employees using pneumatic nail guns utilized eye protection. Two employees were using pneumatic nail guns to install the shingles to the roof without eye protection. The employees were exposed to struck-by hazards.

Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems: On April 12, 2023, employees of Maya Construction, LLC were installing shingles on a residential building located at 348 Mitulski Drive, Wentzville, Missouri. The employer did not ensure that fall protection was utilized by workers. The employees installing shingles on the roof were approximately 21 feet above the lower level. The employees were exposed to fall hazards by not utilizing guardrail systems, a safety net system, or a personal fall arrest system.
