29 CFR 1926.1153(e)(2):  Where respirator use is required by this section, the employer did not institute a respiratory protection program in accordance with 29 CFR 1910.134:  a) Terra Technical Services, LLC, 77 South 2nd Avenue, West Reading, PA 19611 - On or about April 12, 2023, employees were engaged in demolition activities, including, but not limited to, the saw-cutting of concrete materials that contained respirable crystalline silica.  The employer's written respiratory protection program was deficient in that it lacked information including, but not limited to, the criteria for fit testing procedures for tight-fitting respirators.  IN THE ALTERNATIVE:  29 CFR  1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  a) Terra Technical Services, LLC, 77 South 2nd Avenue, West Reading, PA 19611 - On or about April 12, 2023, employees were engaged in demolition activities.  The employer's written respiratory protection program was deficient in that it lacked information including, but not limited to, the criteria for fit testing procedures for tight-fitting respirators.

29 CFR 1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)    a.) Terra Technical Services, LLC, 77 South 2nd Avenue, West Reading, PA 19611 - On or about April 12, 2023, employees were engaged in demolition activities, including, but not limited to, the saw-cutting of concrete materials that contained respirable crystalline silica. The employer's hazard communication program was deficient in that it lacked information including, but not limited to, the criteria for:   1. Procedure to follow if the SDS is not received at the time of the first shipment; 2.Procedure to follow if it is suspected that the SDS is not appropriate (e.g., missing hazards); 3. Procedure to follow to determine if the SDS is current; 4. Methods to provide the other employers on-site access to SDSs for each hazardous chemical the other employer(s)' employees may be exposed; 5. Methods the employer will use to inform employees of the hazards in non-routine tasks, and the hazards associated with chemicals contained in unlabeled pipes in their work areas; and 6. Methods to inform other employers about any necessary precautionary measures to protect employees.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
