This condition exposed employees to eye and face hazards from saw kickback/deflection and debris/dust generated by operation of the power cutter.

This condition exposed employees to health hazards related to exposure to respirable crystalline silica.

29 CFR 1926.1153(g)(1):The employer did not establish and implement a written exposure control plan: (a)Top Notch Concrete, LLC at 4301 West 57th Street in Sioux Falls, SD 57108: on or about and at times prior to April 17, 2023, the employer did not ensure employees were protected from health hazards related to exposure to respirable crystalline silica in that the employer did establish and implement a written exposure control plan covering employees that were reasonably anticipated to be exposed to respirable crystalline silica in concentrations above 25ug/m^3 as a 8-hour time weighted average. This condition exposed employees to health hazards related to exposure to respirable crystalline silica.
