29 CFR  1910.266(g)(3): Each vehicle operator and maintenance employee did not comply with the operating and maintenance instructions for each vehicle.   In the alternative:  29 CFR  1910.266(i)(3)(iii): Training content did not consist of the recognition of safety and health hazards associated with the employee's specific work tasks, including the use of measures and work practices to prevent or control those hazards:  On or about April 14, 2023, an employee was performing maintenance / service work on a powered industrial truck without proper training.

29 CFR  1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identified the workplace evaluated;  the person certifying that the evaluation has been performed;  the date(s) of the hazard assessment;  and which identifies the document as a certification of hazard assessment:  On or about April 14, 2023, The employer did not ensure a written hazardous assessment was completed for removing a tire from a powered industrial truck.

29 CFR  1910.266(i)(10)(i): The employer did not verify compliance with paragraph (i) of this section by preparing a written certification record.  The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  If the employer relies on training conducted prior to the employee's hiring or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate.  On or about April 14, 2023, the employer did not verify training of employees through written certification prior to preforming service work on powered industrial trucks.
