29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   On or about April 17, 2023, on the south side of the site, employees performed masonry work on a scaffold more than 10 feet (3.1 m) above the lower level without the use of personal fall arrest systems or guardrail systems.

On or about April 17, 2023, on the south side of the site, employees constructed a masonry wall while standing on the wall 6 feet or more above the lower level without fall protection.

29 CFR  1926.706(a)(1): A limited access zone was not established prior to the start of the construction of a masonry wall.  On or about April 17, 2023, on the south side of the site, employees constructed a masonry wall that measured eighteen feet high, and 7-9 sections twenty-six feet long per section.  The sections of the wall ran east to west and north to south. Employees were working in areas that did not have a limited access zone protecting employees working in and around the cinder block wall.

29 CFR  1926.706(b): Masonry walls over eight feet in height were not adequately braced to prevent overturning and to prevent collapse until permanent supporting elements of the structure were in place.  On or about April 17, 2023, on the south side of the site, employees constructed a masonry wall that measured eighteen feet high, and 7-9 sections twenty-six feet long per section.  The sections of the wall ran east to west and north to south. Employees were working in areas that did not have a limited access zone protecting employees. The cinder block wall was not adequately braced nor did it have permanent supporting elements to prevent overturning while employees were working around the unbraced cinder block wall.

On or about April 17, 2023, on the south side of the site, employees constructed a masonry wall while standing on the wall 6 feet or more above the lower level without fall protection. The employer failed to provide a fall protection training record.
